The following paper represents the current state of research into the use and usage of the Internet for marketing purposes by small medium sized enterprises (SMEs). The paper discusses how the research was established, its design and development, and sets out the operational parameters addressed. It also identifies the factors that SMEs view as critical to the success or otherwise of their development of a web presence. * What is the main driver for an SME to develop a web site * What are the main, identifiable marketing benefits and drawbacks of a Web presence for an SME
Not a day goes by without yet another article extolling the virtues of the Internet. An estimated 30 million worldwide users to date and more logging on every day. To the small business owner, the real question is, Where does the hype end and the reality begin? Is the Internet really a viable proposition for the traditional small business, normally constrained by lack of time, staff and money? 10 questions to ask yourself The best way to determine whether or not the Internet makes sense for your business is to apply a simple “yes” or “no” answer to 10 important marketing questions: 1. Do my clients require specific product information before they can buy my product/service? 2. Do I spend a majority of my time selling the benefits of my product only to be asked, “Can you send me more information?” 3. Is my long-distance phone bill more than $100 per month? 4. Have I lost business as a result of playing phone tag with a potential customer because I was unable to “sieze the moment?” 5. Would a new employee handling sales paperwork free me to increase my companys revenues? 6. Is there an international market for my product? 7. Does my product have a story to tell? 8. Am I spending more than 20 percent of every dollar I make on marketing-related expenses? 9. Would instant customer feedback benefit my business? 10. Would the ability to capture orders 24 hours a day, 365 days a year, help my business? If you answered “yes” to just one of these questions, you should at least explore the possibilities that Internet commerce can offer. If you answered “yes” to five or more, you should dedicate some serious time and resources to finding out how the Internet actually works (and how it can work for you). If you answered “yes” to eight or more of the questions, you need a fast-track education about the Internet before your competitors claim the medium for themselves. The smart small business owner will make plans to explore the Internet, find out what the Web can deliver and then formulate a strategy to exploit it. As Jeff Vick, Marketing Specialist at Creative Video explains, “The Internet will do to business in the 21st century what the telephone did to business in the 20th century.” The Web — How does it work? According to Vick, the Internet works well as a commercial sales tool for businesses that need to exchange information in order to specify a particular products size, color, model, price, etc. Multiple orders can be booked, billed and fulfilled through a simple response mechanism included on an Internet site. Much of this information can be communicated through the Web. While it is actually only one portion of the Internet, the Web serves as an extensive reference library that can provide any level of additional information about a particular subject, issue, item or product. As in a spiders web configuration, the Web provides an ever-increasing source of interlocking information about the subject in question. Simply point and click and you can dive deeper into additional layers of information. The Web also has certain features that make it ideal for marketing. It can display pictures and massive amounts of text about your product as well as send and receive order information while at the same time generating a receipt. If your product requires a lengthy explanation in order to communicate its benefits, the Web is the place to do it. Customers and prospects can view that information at their own pace — in many instances, via sophisticated video and audio commercials. Since were talking digital information here, there is very little difference between one word and one thousand words. And if you feel that youre spending too much time processing paperwork and not enough time selling, a well-designed Web page may be one of the potential keys to your businesses future success. How important is e-mail? An important byproduct of the Internet is e-mail, or electronic mail. Once you learn to use this valuable tool, youll wonder how you ever got along without it. Forget about what time it is, or whether its “worth a call” — with e-mail, it costs no more to send a message to Sydney that it does to Syracuse (the actual cost is about $1.00 an hour). And time zones become irrelevant as well. You and the recipient can view the messages at your convenience, thereby eliminating the dreaded game of telephone tag. So get serious! How does the smart business operator approach the formidable and intimidating task of investigating the Net? First, gather your thoughts as to what you would like your Web site to accomplish. Imagine that your customer can ask you anything he/she wants to know about your company and product — anything from product price to employee birthdays — and in no particular order. Analyze each possible scenario and list all the information relevant to it. Then, and only then, begin to organize the scenarios into a flow chart. Once you have the flow chart polished, try to find flaws in it. If your customer is browsing through the pricing section of your flow chart, will he/she be more interested in going to shipping next or reading your companys mission statement? After you feel that youve developed a solid grasp of the different portions of the business that youd like to present to your clientele, you are now ready to interview potential agencies who are skilled in creating Web pages. According to Vick, there are 3 questions you should ask a potential Web page creator: 1. Have you done this before? 2. Who have you done this for? 3. May I call them? While creating some Web pages may require the skills of a computer Ph.D., most will not, and there are competent companies in most major markets capable of accomplishing the task in a cost-effective fashion. Prices for creating a simple Web site can range from a low of $2,500 to high of $20,000. In fact, some of the Fortune 500 marketers have created sophisticated and complex Web pages that can literally run into the hundreds of thousands of dollars, and in some cases, the millions. But for the average small business, the investment will probably be in the $5,000 to $10,000 range. And remember, you must keep your Web site content fresh, or your prospects will have no reason to come back. Seeing your own World Wide Web site up and running on the Internet can be a proud moment for any business owner. It also can mean the start of a whole new way of doing business. It has the potential to increase productivity by extending operating time to a full 24 hours a day. But this will only happen if your business really needs this technology and can use it effectively. Evaluate your situation honestly. If its right for you, acquire it. If its not, save the money. And if you want to see what its all about, contact a Web creator and ask to see a demonstration. One picture is really worth 1,000 words. Alf Nucifora is an Atlanta based marketing consultant. He may be contacted by e-mail zubicon

This week, all over the country, most NFL players and coaches are packing their bags, waving goodbye to their families and heading for training camp, a yearly ritual that dates nearly to the origin of the league. For six weeks, grown men live in college dorms, are forced to obey curfew and endure grueling two-a-days in the late July and early August heat. After all, how were players expected to stay in game shape when they were selling furniture or tending to the fields at the family farm? In those days, players needed the full six-week camp to work themselves into playing condition, learn new plays and perfect existing ones. Some of todays players still need a month and a half to get in shape; they milk the system because theyre allowed to. But that doesnt mean preseason should stay the way it is.
WHITE walls, featureless furniture and drab drapes were turning Ally and Chris Whites boring living room into a no-go zone. It was cold and characterless, and the couple, both 34, knew that drastic action was needed to inject it with some va-va-voom. So, with the idea of creating a contemporary and comfortable room where Oscar could happily play with his toys by day and where Ally and Chris, a business director, could relax together in the evenings, she set about finding the perfect colour scheme. Ally started by trying out various paint swatches on the wall. “I didnt want to go for traditional magnolia,”says Ally. “But at the same time I was anxious about using grey in case it turned out too cold. So I used large A3 sheets of paper painted in the shades of grey I was drawn to and placed them around the room, keeping an eye on how they worked at different times of the day.”

Elliott points out that managed care organizations like HMOs and PPOs are requiring members to have coverage. In addition, a number of states have adopted more stringent licensing requirements for chiropractors that include mandatory malpractice coverage. “Theres an increase in the pie itself,” Elliott notes, in explaining why National Union and other companies have opted to enter the field at this time, adding that even chiropractors that had coverage may be looking for higher limits to meet HMO and PPO requirements. “Theres a real need in the marketplace for a strong company with experience in professional liability.”Another factor that has induced new entrants is the fact that, despite increased competition, “rates have been holding fairly steady,” Elliott says. “Premiums are relatively small to begin with so, to a great extent, competition is based on coverage,” he adds. The National Union program offers both claims-made and occurrence policies, with defense costs provided outside the limits. Coverage is provided for manipulation under anesthesia, where allowed. Limits range from 100/300 to $1 million/$3 million. “Basically, we cover anything thats allowed under state law,” Elliott says, explaining that “this industry is pretty well looked after. State laws are pretty strict.”
With PTs pressing to make chiropractic a specialty of physiotherapy, the WFC is supporting the Brazilian Chiropractic Associations fundraising campaign to promote chiropractic legislation. At the heart of the battle is the right of Brazilian chiropractors to protect their title and their profession as a separate entity from physiotherapy. Currently, chiropractors in Brazil have no legal protection. The government-approved regulatory body that licenses and regulates physiotherapy, the Council of Physiotherapists and Occupational Therapists (COFFITO), has ruled that chiropractic is a specialty of physiotherapy. As a result, several part-time courses have started up (with the support of COFFITO) that provide a certificate in “chiropractic” to physical therapists after as few as 100 to 300 hours over a series of weekends. Graduates of these courses have formed the Brazilian Physical Therapists Chiropractic Association, hoping to legalize chiropractic, but as a specialty of physiotherapy. One of the ABQs (and the WFCs) biggest fears is that if chiropractic is only legally recognized as a specialty of physiotherapy, the trend may spread to other countries. A chiropractic specialty course is currently being developed in Chile by a physiotherapist, and PTs in Spain, Portugal and Egypt have been encouraged to push for chiropractic as a specialty in their own countries.
My own practice was constructed as a part of the local group of health care practitioners in my community. I sought out the best primary care physicians, physical therapists, neurosurgeons, orthopedic surgeons, and physiatrists to associate with, and referred to them when it was clear that my form of intervention was not helping the patient. In this sense, I was an “integrative chiropractor” because I saw to it that the patients best interests were served in two ways. First, the patient received the best conservative care first (chiropractic) before moving on to procedures of greater risk. Secondly, the patient was free to talk openly with me and with the medical providers about all the practitioners involved, without fear of derision or embarrassment. No one was competing for the business of the patient; we were only working as a team for the patients welfare. My network included the chiefs of staff of local hospitals and spinal orthopedics at Stanford University Hospital, the best orthopedist for knees and shoulders, the best family practice physicians, and so on. Therefore, I could honestly say to the patient that he or she was getting the best care possible. In my interviews with the physicians, I learned as much about their residencies and practice patterns as I could. If they were the best at knees, where did they obtain that specialty? How many knees had they “done” in their residency? How did they currently fit in with the provision of health care in their community? Sometimes a less-flattering side of health care services would emerge from our conversations. Although I had achieved just a glimpse of the overall situation, it was clear I myself was not really a member of this healthcare system that had its own massive structure, credentialing and accreditation framework, hierarchy, rivalries, and troubles with a changing healthcare environment.

This may be an unpopular position to adopt, but some of us are going to miss him, you know. Of course were aware of his disadvantages - hes got a bit of an obsession with abroad, for example, whether for holidays or invading - but you have only to clock his easy way with the bag containing his Fender Stratocaster to know this is a born entertainer. And he has brought his own unique gifts, whether showing the touch of a Sinatra over his retirement, the ease with a catchphrase - “pretty straight kind of guy”, “45 minutes”, “peerage?” - or the mastery of the telling, colourful and often intriguingly vague detail, whether it be working as a waiter in Paris, or his earlier bid for a free holiday when, as a teenager, he tried to stow away on a jet bound for the Bahamas. Such things cling to him. Fine details around the Miami trip include the hairy landing; the 24 imported privacy protecting palm trees; jamming with the Gibbs; the suggestion that Mrs Gibb, as a bisexual druid, disapproves of tennis, and now, the quiet (presumably in deference to Mrs Gibb) mass in ritzy Palm Beach, complete with Aston Martin. Come on: didnt you also feel an unworthy tinge of regret at promises from the Brown camp of a “humbler”, less showy premiership?

This annual report is the result of an annual census of dentists in the United States, conducted by the American Dental Association (ADA). Report data represents ADA member and non-member dentists, professionally-active dentists, and dentists who are retired or no longer in private practice. Data in table format by region and state, with U.S. totals. Percentages included where appropriate.
While it may seem inconceivable to the 50 percent of Americans whose anxiety and fear of pain keeps them from regular checkups, an enjoyable, spa-like dental experience is possible, and it is available in the Lansing area. In October 2003, the Valleys, associate Dr. Sarah Faber, and the entire staff attended the American Dental Associations (ADA) annual session in San Francisco where they had an opportunity to study the latest in patient pampering methods and how to incorporate them into their practice. Management Consultant Shirley Brown, a practicing dentist and clinical psychologist, and speaker at the ADA session, said the consumer media have coined the term “dental spa,” but many practices offer services and amenities specifically designed to relax patients without considering themselves a “spa.” Since dentists run dental practices as independent businesses, each dentist decides what patient services to offer. The International Medical Spa Association (IMSA) defines a dental spa as “a facility whose dental prograin is run under the strict supervision of a licensed dentist that provides services, integrating both traditional and non-traditional dental and spa treatments (such as massage therapy, skincare and body treatments).”

Consumers are spending more than ever on health and beauty treatments, a reflection of the increasing emphasis on looking young and attractive. If the market is to grow significantly in the future, operators will need to make treatments more affordable and accessible to a wider range of consumers, especially men.
“If people have greasy hair or bad skin, they often take it for granted that that is how things are,” she says. “But theres no reason why you shouldnt look great: how you look on the outside relates to what you put in.” This concept may not be exactly revolutionary, but if most of us examined how we approach food in practice, Stewart believes, we would soon change our minds. Take the “spare tyre” stomach phenomenon, for instance. A genetic disposition towards fat settling in this area can make it difficult to lose, and when weight loss seems impossible, many people resign themselves to their fate. But this doesnt have to be the case, argues Stewart. Her book points to the fact that low oestrogen levels can be associated with this particular problem, and as a result it seems that certain food types can actually help to shift the bulk. Along with exercise (of course), Stewart suggests that sufferers top up on phytoestrogens, a type of oestrogen that mainly occurs in pulses, linseeds, and other plant food. Stewart also has plenty of suggestions for skin problems. People who suffer from eczema, for instance, can expect an improvement if they reduce their exposure to house dust mites, and replenish supplies of vitamin B, zinc and fatty acids, all of which can have an affect on the quality of skin. A couple of months of this, says Stewart, along with a boost of evening primrose oil, should reap its rewards.

Banner, like Brown and the Rock and Ice men, was a Lancastrian, but began his outstanding climbing career while studying chemistry at Bristol University in the early 1950s. Here he was one of the pioneers of the strenuous, fin-gery climbing on the forbiddingly steep limestone of Avon Gorge. Bold, extreme climbs such as Great Central Route and the aptly named Desperation, climbed in 1953, epitomised Banners vision in opening up lines on a formidable cliff few had dared to consider seriously as a climbing ground. Out of term time, he kept his standard topped up on the highly technical sandstone of his local crag at Helsby while based at his parental home in Lancashire. Banner soon became almost as famous for his feats of derring-do on his Vincent motorbike as on his climbs, reaching over 100mph on a straight bit of road going past Helsby Grammar School on the way to his local pub in Frodsham. “In the pub he would outline his next plan, spoken in a slow nasal drawl,” recalled Jones, “fingers delicately gripping the top of his pint pot while he slowly ran them round the smooth rim.” Following a two-year break for National Service, Banner plunged back into the fray, determined to smash the psychological barrier created by the Rock and Ice on the crags of Britain by becoming the first to repeat many of their fabled routes. His obsessive pursuit of this task distracted him from pioneering many new routes, something he later regretted. But those he did create tended to be extremely noteworthy.
> Installing banners can be a one-person job thanks to the Sure-Twist Banner Bar from FFr. This banner bar allows one person to position banners without assistance. The bar is designed to let the installer know when the banner bar is attached securely from the ceiling. The single bar with three hanging holes slides easily onto a 1-inch ceiling grid, locking securely into place with one twist, meaning any banner can be hung evenly, quickly and securely with one easy lift motion.
How do advertisers capture kids attention between mouseclicks? Advertisers, in their never-ending quest to capitalize on the quickly changing tastes of 2-to-12-year-olds, are taking a fresh look at kids online communities as a way of reaching their target audience and influencing young decision makers brand impressions. The drive to reach kids on the Web has intensified. Jupiter Communications, the New York City-based online research organization, projects that the number of kids online ages 2to 12 will swell from more than 5 million in 1998 to nearly 21 million by 2002. While banner ads have been a mainstay on kids Internet sites, marketers are frantically searching for new vehicles, such as sponsorships of chat areas, contests, interactive games, promotions and anonymous data polling to make their mark on kids. “When it comes to kids, there is not just one right way to advertise,” says Idit Herel, CEO and founder of MaMaMedia, a kids online community “The click-through rates are higher for kids than adults. Theyre risk takers and explorers, and you have to understand what they find intriguing and interesting.”

The new product will retail between $8.99 and $9.99.
A $4.5 million settlement award will be divided among nearly 53,000 Black women who sued a former maker of a widely advertised hair straightening product because the product caused baldness, green scalps and other health problems. The decision against the now defunct Los Angeles-based World Rio Corporation was issued in Detroit by U.S. District Court Judge Gerald Rosen. The courts recent ruling was the end result of a major class-action lawsuit against World Rio originally filed as more than 650 lawsuits nationwide.
Hair-product advertising is wonderful. Think what its given us; the arc shot (shiny long hair moves 180 degrees in slow motion); the tumble shot (shiny long hair tumbles down a slender bare back); the computer- graphic hair-shaft situation (scientific miniature magic happens). But the conventions of Big Hair Advertising have that Reagan period look; theyre obviously the aesthetic of a generation before the Starbucks lofts-for-all lobby, the world of Gap and CK one. Fructus is, in marketing- speak terms, a second brands sub- brand. Theres a Fructus look - younger, unisex, not so obviously Seventh Avenue - and a Fructus palette; its citrus, with a lot of lime slices. Its not exactly Hoxton Square, and certainly not Genoa/ Gothenburg/Seattle but its moved on a lot from early Cindy Crawford. So we get a girl with bad hair - frizzy hair - pouting miserably, in black and white. “Is frizzy hair doing your head in?” says the voiceover, who sounds like a Saturday morning TV presenter, a sort of Home Counties Mockney Mild. Doing your head in isnt LOreal main brand language, which is relentlessly upbeat (”because Im worth it”). The answer, as always, lies in fruit therapy. Fruits are saints who give you long-lasting frizz control. Fruit therapy lets you move on (and now that really is important language, because moving on is a crucial concept in shrink-speak). You move on to the first day of the rest of your life with fruit micro-waxes. Did you know that fruit contained micro-waxes? Well it does, and theyre combined in smoothing milk (dont worry, haircare language has a higher logic that rises above kitchen pedantry) that makes everything super- smooth. As hair gets straighter, the world gets happier and the screen gets more colourful, as swirly as a citrus lava-lamp or a Gordons Gin cinema commercial. Boys and girls cluster for a Fame Academy group shot and everything is completely life-affirming and as organic as you can get in the aspirational mid-market, 20 through 35.

Wood and Poly Shutters Provide Relief for Homeowners ONTARIO, Calif., June 25 /PRNewswire/ — Summer is here and homeowners are seeking ways to keep their homes cool while keeping a lid on utility bills. Energy-efficient window treatments, such as wood and poly shutters, are a popular option to ensure that energy transfer will be reduced thereby maintaining proper room temperatures in both the summer and winter times. In addition to being energy-efficient, wood shutters are also eco-friendly (AvalonShutters.com/environment.html). Avalon Shutters builds its custom shutters with Bamboo and Basswood, a lightweight, sustainably-harvested hardwood that does not warp, is naturally low in sap content and is recyclable, biodegradable and renewable. Painted and stained shutters are also finished with a water-based coating that contains zero and ultra-low volatile organic compounds (VOCs).
ONTARIO, Calif., July 8 /PRNewswire/ — Avalon Shutters, a leading manufacturer of custom wood shutters, announced its new transferable limited lifetime warranty today. Effective immediately, the new warranty can be retroactively applied to all Avalon wood shutters built and installed since the companys inception 22 years ago. The decision to upgrade our warranty reflects our whole-hearted commitment to the overall quality of our wood shutters, said Bob Marcynyszyn, co-owner of Avalon Shutters. Given that shutters become real property once installed and adds permanent value to a home, we believe our customers deserve a warranty that can be transferred to the next homeowner, added Marcynyszyn. Its not uncommon for wood shutters to remain in homes for decades.

TWO millionaire property speculators plan to open a network of 500 drive-in dental clinics in response to the desperate shortage of NHS dentists. Judith and Fergus Wilson want to open - clinics near motorway junctions with dentists from Eastern Europe. Record numbers of Brits now fly to countries such as Hungary and Poland because they cannot afford private treatment here.
treatment because some areas are “deserts” for NHS dentists, a Health minister, Baroness Hayman, admitted. She told peers there was a “problem”, which would “take time to turn around”, of dentists withdrawing from the NHS.

KRAMER, DDS, LLC The goal of this business is to provide high quality general dentistry with a moderate to high price using the highest technology possible. Prices will be justified by the advanced technology used and the lifestyle conveniences that the dental practice will offer. The dental practice will be positioned as a place one can get high quality dental work in an environment of convenience and technology.
The crisis in NHS dentistry is set to continue as the Government yesterday announced reform plans that will further curtail dentists clinical freedom and threaten their income. Gerald Malone, Minister for Health, said that the “prior approval” scheme, under which dentists must seek permission for certain expensive or complex treatments, is to be extended and made “more rigorous”. Dentists leaders, said they were “disappointed” with the proposals. They claimed that Mr Malone had missed an opportunity to resolve the three- year dispute with the profession which has seen thousands of dentists leave the NHS or turn away new patients. Nearly a million adults and children have been deregistered by their dentists in the past four years.

vending machines

Posted by on 12 Aug 2008 | Tagged as: Uncategorized

“Dozens of the machines have popped up in suburbs and rural areas around New York City in the last two years,” the Times reveals, “and Daniel M. Bartholomew - a Hudson Valley, New York farmer turned worm tycoon has quickly become the countrys second largest operator of the devices.” Starting with one machine last year on his front lawn (which was generating $900 a month) Bartholomew now has 28 with plans to have 100 by the year 2000. Worms can stay alive for as long as 10 days on the mix of peat moss and powered newsprint in the cups. Machines have a thermostat that keeps the bait at 40 to 45 degrees in summer and warmer in winter to serve the needs of ice fishing. Bartholomew has set up machines at marinas and small convenience stores near boat docks, where people can “pick up beer, ice and bait in one place.” About his future with worms and vending machines, he enthuses: “The skys the limit.” Over the years, in these pages, we have written about commercial developments of vending machines that accept recycled containers and give the correct coins back to the recycler. The machines were specifically manufactured for use at deposit centers (supermarkets, for example) in states that had passed mandatory deposits on soda bottles, cans, etc. Unlike the worm vending machines, the ones for bottles have taken a slower route to commercial success. But latest reports indicate continued progress.
Vending Machine Cuisine William R. (Bill) Farhat was a restaurateur in Grand Rapids when some representatives of vending companies asked him if he could make sandwiches for their machines. With a restaurant kitchen, it really wasnt possible, Farhat recalls. But he asked the vendors if preparing food was a problem for them.
One morning in October, Mike McGee stopped to inspect the Coca- Cola vending machines that he had installed in a new student recreation center at Harvey Mudd College in Claremont, Calif. “Back in the old days, they came around here saying, `Sell our product,” recalled McGee, whose father started the business in 1961. “Now that we need their product, they say, `Well still sell it to you, but were also going to be in business against you.” So McGee pulled his machines from Harvey Mudd, just as he took machines out of nearby Scripps College and two accounts serving California city buildings a few months ago. “Theres just no way I can compete,” he said. Vending machines, a highly profitable market, have become an important new battleground in the soft-drink business, and Coca- Cola, through its bottlers, is by far the biggest and the most aggressive competitor. “Were in a period of intense competition between bottlers and full-line vending operators for the control of soft-drink vending machines,” said Elliott Maras, editor of the trade magazine Automatic Merchandiser. For consumers, the battle has led to greater availability of soft drinks at somewhat lower prices. But many Coke-vending-machine owners and distributors across the United States complain that the fight is not fair. They say that Coca-Cola, which owns 44 percent of Coca-Cola Enterprises and all the rights to popular brands like Coca-Cola, Diet Coke and Sprite, is using its dominant position to take business away from them. The power of Coca-Cola bottlers over distributors, they say, is further enhanced by a 1980 federal law that gives local bottlers exclusive rights to sell soft-drink brands in a certain territory. More often than not, in Cokes case, the local bottler is Coca-Cola Enterprises, which did $3.2 billion worth of business last year, according to an earnings report. The complaints have led to investigations and lawsuits in several states, people involved in the inquiries said. A spokesman for Coca-Cola Enterprises said the company played by the rules. “We deal with our customers in a fair and equitable manner,” said spokesman John Downs Jr., “creating value for them and satisfying the refreshment needs of our consumers.” He added, “It is our policy to fully comply with all laws and regulations applicable to our business operations.” Distributors who are accustomed to selling Coca-Cola products — which have a 43.9 percent market share in the United States — but are troubled by the presence of Coca-Cola Enterprises as a rival say that they cannot simply switch to selling other brands: Their investments, market demand and other competition prevent it. At the same time, they have no choice but to buy from the local bottler because Coca-Cola will penalize any bottler that sells to customers from outside its designated territories. As a result, say many smaller vending-machine owners and distribution companies, a bottler can raise prices at will and otherwise dictate the terms of business. “My opinion is, they overprice us in order to keep us in a less competitive position than they have,” said Ladd Little, who runs L.C. Vending, his familys company in San Antonio. Like McGee, he is a customer of Coca-Cola Enterprises, which controls the Coke bottling business in most of Texas. Little says that the price Coca-Cola Enterprises charges him is higher than what he can find elsewhere. “I buy a truckload a week,” he said. “I can buy it for less at the grocery store. But they wont allow that grocery store to sell it to me in quantity, either.” Several New York distributors say they are trying to organize to resist the competition from Coca-Cola Enterprises. “We just want them to sell us the product for the same prices that they sell it to themselves,” said one distributor, who spoke on the condition of anonymity. “Theres got to be something wrong with being the wholesaler, and the retailer, and being protected by the law.” Constance L. Hays prepared this article for the N.Y. Times News Service.

HypnotherapyHypnotherapy is a combination of hypnosis and therapeutic intervention . The therapist leads the patient to positive change while the patient is deeply relaxed in a state of heightened suggestibility called trance.
Cognitive Hypnotherapy. Thomas E. Dowd. Northvale, NJ: Jason Aronson (2002). 240 pages, $40. Reviewed by: Bruce N. Eimer, Ph.D., ABPP, Philadelphia, PA. Until recently, there has been little in the CT literature on the use of hypnosis (Golden et al., 1987). In the language of the laterality of brain functions, cognitive therapy has emphasized “left brain” thinking as opposed to “right brain” creativity and imagination. In Cognitive Hypnotherapy, Tom Dowd successfully changes this emphasis-adding “right brain” to what was mostly a “left brain” art. For CT and CBT practitioners, Cognitive Hypnotherapy offers options for expanding the scope and flexibility of their practice by adding hypnosis to it. For clinical hypnosis practitioners, this book models efficient ways of integrating cognitive restructuring and reframing techniques with direct and indirect, permissive, hypnosis trance induction and therapeutic suggestion techniques.

14 June 2007–World Blood Donor Day–focused on improving safe blood supply to prevent maternal mortality. Every year, about 125,000 women die in developing countries due to severe bleeding during delivery or after childbirth, making it the most common cause of maternal mortality. This accounts for 25% of global maternal mortality. Timely and safe blood transfusion can make the difference between life and death for many women and their newborns.
THE WORD accident, by definition, is an unplanned or unexpected event that can cause injury or loss of life. But, can the rate of recurrence of any such event be controlled or regulated? Statistics show that nearly 75 percent of all Army accidental fatalities have been caused by vehicular accidents, be it Army motor vehicles, combat vehicles or privately owned vehicles, Powell said. In all the accidents, driver errors such as speeding, fatigue and improper reactions have been major contributing factors. So a cultural change in life skills behind the wheel is needed to really quell this problem. The USACRC traffic section, in conjunction with General Motors, has decided to confront the problem head on.
Organizational climate differs from culture in its lack of permanence and stability. The safety climate in particular, is a snapshot of employees perceptions of a current environment or prevailing conditions, which impact upon safety (Mearns et al., 2000). Based on common themes in various definitions of safety climate. Wiegmann et al. (2002) derived the following definition of safety climate: [ILLUSTRATION OMITTED] Safety professionals and organizational leaders cannot overlook the importance of safety climate within their organization. The safety climate can fluctuate with real-time influences, such as new leadership, organizational changes, and environmental impacts. Safety managers, and corporate managers in general, must be vigilant for climate changes, realizing the constant fluctuation. Through diligence and effort, the climate can possibly be controlled with incentives, training, and participative process. At the beginning of this chapter, the quote from General Eberhart pointed out that risk is inherent to an organization; the safety challenge is to identify hazards, eliminate or mitigate risks, and make smart decisions on what risks we will and will not accept. This applies to everyone and every activity, and determines if we are safe enough. Risk management requires prevention methodology: identify hazards, report them to appropriate people, assess the risks, choose the best solution, and monitor. Sometimes we must accept risk, but must accept it at the right level–strategically, operationally or individually. In managements effort to win the risk game, sound organizational structure and solid corporate processes that achieve prevention methodology will, in the end, effectively manage organizational risks, and provide a comforting answer to the question, Are we safe enough?

Hard Money Commercial Lenders

Posted by on 12 Aug 2008 | Tagged as: Uncategorized

Commercial lending is frequently thought of as one of the few remaining unregulated business activities, free from the plethora of laws and regulations that place numerous restrictions on other financial services businesses. Many commercial lenders would be surprised, however, at the number and variety of rules applicable to commercial lending activities. Following is a brief review of key laws and regulations which have potentially significant implications for commercial lenders. (References to “banks” below generally includes thrift institutions unless otherwise noted.) ECOA prohibits discrimination in the extension of credit on the basis of race, color, religion, national origin, gender, marital status, age (provided the applicant has the capacity to enter into a contract), because all or part of an applicants income is derived from a public assistance program, or because the applicant has exercised a right under the Consumer Credit Protection Act. The Act applies to all types of consumer and business credit transactions, although it has a limited impact on public utilities credit, securities credit, incidental credit and government credit. To ensure compliance with ECOA, commercial lenders must have an effective nondiscrimination policy, adopt procedures and forms for providing notice of “adverse action” (e.g., a denial of or counteroffer to a loan application or an unfavorable change to an existing credit), ensure that marketing efforts cover all geographic segments of the market and, if they make multifamily housing loans (including for construction, development, or rehabilitation), post Equal Housing Lender notices in publicly accessible offices (including offices adjoining a bank branch office). In addition, commercial lenders should ensure that sales, marketing and underwriting staff understand the concept of “disparate impact,” under which the critical issue is not whether discrimination was intended but whether the effect of a lenders act or practice was discriminatory.
Editors Synopsis: This article examines the benefits that Subordination, Nondisturbance, and Attornment (SNDA) Agreements provide to lenders, landlords, and tenants. The authors discuss provisions that protect lenders and tenants, and review developments in the law related to SNDA agreements. However, even the most favorable leases, standing on their own, do not provide the security that lenders seek. The leases are mutual promises between landlords and tenants that do not form a direct contractual relationship between the producers of the income that have formed such an important part of the lenders underwriting (the tenants), and the parties secured by the income (the lenders). Absent any contractual agreement between lenders and tenants, both parties are subject to the operation of the applicable law in determining whether they can retain the benefits they anticipated when deciding to proceed with their respective contractual commitments. A foreclosure may expose the lender to the risk of losing relied-upon lease income, and the tenant could lose its leasehold interest in the mortgaged property-a result that, under normal circumstances, would work to the detriment of at least one of the parties.2

Factories and machine shops use automated controls, sensors, and continuous electric arcs to make faster welds better. METAL FABRICATORS SEEK to increase their productivity and quality by upgrading their welding processes. In response, welding system manufacturers, such as Lincoln Electric Co, of Cleveland, work with robot manufacturers, including ABB, to integrate their products and tailor automated welding systems that make faster precision welds. Despite the popularity of robotic welding in high-volume applications, many machine shops continue to thrive because of the skills of their human welders. By combining continuous electric arc technology and smooth wire feeding mechanisms in its Power MIG 200 system, Lincoln Electric is enabling welders to increase their productivity by 20 percent, while reducing the reworking of finished parts.
The facility will focus on strengthening the education of welding technicians and increasing the number of available welding technicians.

Health is a measure of quality of life that is difficult to define and measure. In the 1940s, the World Health Organization (WHO) defined health as a state of complete physical, mental, and social well-being and not merely the absence of disease or infirmity. At the first International Conference on Health Promotion in Ottawa, Canada (1986), the Ottawa Charter for Health Promotion built on the WHOs concept and further defined health as a resource for everyday life. a positive concept emphasizing social and personal resources, as well as physical capabilities. Good health enables one to function independently within a changing environment.

Pocket gophers are fossorial (burrowing) rodents–so named because they have fur-lined pouches outside the mouth, one on each side of the face. These pockets, which are capable of being fumed inside out, are used for carrying food. Pocket gophers are powerfully built in the forequarters and have a short neck; the head is fairly small and flattened. The forepaws are large-clawed and the lips close behind large incisors. This feature allows them to use their incisors for digging without getting a mouthful of dirt, a unique feature to gophers. There are over 30 species of pocket gophers in the Western Hemisphere. Pocket gophers vary in size from 5 1/2 inches in length to over 13 inches in length. Litter sizes vary from one to 10 but typically average three to four. In the northern part of their range they have one litter per year, as opposed to up to two in the southern ranges. Young gophers are dispersed above ground and are capable of swimming as well on the search for suitable habitat to begin new burrow systems. Pocket gophers feed in three ways: they feed on roots, above-ground vegetation, and they pull vegetation into their tunnel to be stored in food caches for later consumption. In the vineyard, pocket gophers girdle vines, damage roots systems (most often in new plantings), and cause multiple-irrigation problems by promoting erosion and damaging drip lines. They are solitary little beasts, vigorously maintaining and defending their tunnel system. Depending on the species and available habitat, gopher population density may vary from six to eight per acre, to up to 62 per acre. Gophers do not hibernate and only cohabitate during the breeding season The burrowing activity of one gopher produces up to 70 mounds in one month. So how do you control such an active but solitary rodent? The fact that a gopher is solitary works to your advantage. You have three basic pest management tools for gopher control: Biological control, chemical control and trapping.

GROWTH IN SPORTS PROGRAMMING CONTINUES IN MOST SERVICE SETTINGS, BUT ONE OF THE MOST PROLIFIC GROWTH AREAS IS FOUND AMONG THE NATIONS COLLEGES AND UNIVERSITIES. Growth in sports programming continues in most service settings, but one of the most prolific growth areas is found among the nations colleges and universities. This area is growing because of the age range of the population it serves, the ability to provide adequate on-site facilities for comprehensive programming in a variety of sports activities, and the opportunity to conduct programs for different levels of ability and interest. Recreation on college campuses, referred to as recreational sport, traces its roots to the early twentieth century. As schools began to develop athletic departments in the late 1800s and early 1900s, administrators realized that although a significant population was served by the athletic program, there were many students who could not, would not, or simply did not participate in intercollegiate athletics. Thus, there was a need for sport participation among the masses. Colleges and universities were frontrunners in the development of sporting pursuits in America (Snyder Spreitzer, 1978; Dulles, 1965), and it is generally recognized that recreational sport was born in 1904 at Cornell University.

LAS VEGAS — In multiple gestations, dont rely solely on the mothers perception of how the fetuses are positioned when monitorig fetal heart rates, Patricia M. Witcher, a registered nurse clinician, advised at a conference on fetal monitoring sponsored by Symposia Medicus. An ideal way to identify each fetus before heart rate monitoring would be to use ultrasound, but thats not realistic because most people who initiate monitoring dont do ultrasound, said Ms. Witcher, a nurse at North-side Hospital in Atlanta who specializes in labor and delivery and high-risk obstetrics. The best way to identify each fetus is by doing simultaneous monitoring and looking for divergence of fetal heart rate tracings. Thats really the only way we have of ensuring that we have a heart rate for each fetus, she said.

The reconstituted CSD board halted construction and dismissed the agencys general manager, attorney and public information officer. Board members have indicated they would pursue a different type of treatment plant to be built outside of town. Indirectly, the board has picked a fight with state agencies that have been working for years on water quality improvements State regulators have insisted since the 1970s that Los Osos needs a wastewater treatment facility. The town of 14,000 people relies on 6,000 individual septic systems, which regulators blame for polluting the groundwater and Morro Bay estuary. “[L]awyers in criminal courts are necessities, not luxuries.”1 Of course, the record of Burdines trial cannot possibly indicate precisely when Mr. Cannon was asleep or awake or what trial happenings Cannon observed or missed because he was asleep. However, it was established that he missed “substantial portions” of the case against Calvin Burdine.14 Therefore, it is not surprising that the jury convicted Burdine of capital murder and sentenced him to death. What is surprising is that when Burdine complained of his trial counsels inexcusable behavior to Texass highest court of criminal appeals, the court summarily held that, although Burdine did prove that Cannon slept through substantial portions of Burdines capital murder trial, Burdine had not proven that he received ineffective assistance of counsel in violation of the Sixth Amendment.15 It was not until over sixteen years later that a divided court agreed with Burdine that the lawyering he received at his capital murder trial was constitutionally inadequate.16 Although ruling in Burdines favor, the court did so over strong and vociferous dissent.17

For years, Remodeling magazines annual “Cost vs. Value Report” has offered comfort to homeowners investing hefty dollars into home improvement projects. The high payback on the most popular rehabs - kitchens and bathrooms - has even been the catalyst to spur some homeowners to remodel. They felt confident that if they did good work, theyd get back most of their funds. Does this mean that homeowners should stop renovating? Hardly, especially when they have a distinct vision of how they want their home to look and function - and if they have the funds. But decreasing numbers suggest greater caution: - Never overimprove. Take the value of your existing home, add in the cost of your potential improvements and be sure the new sum doesnt exceed the value of comparable neighborhood homes.

QI AM worried about the Airtours package I have booked for our familys annual summer holiday next July. I havent yet had to pay anything, but if I do and the company goes bust will I lose my money? - Kevin Tide, Bristol. Concern about the MyTravel group, which includes Airtours, started when auditors uncovered a pounds 50million accounting shortfall. To change arrangements now may result in difficulty getting the same dates, hotels and resorts. Different rules apply to flight-only deals so buy using a credit card to safeguard your ticket. QI FANCY pushing off somewhere warm for a few weeks before the Christmas season sets in. I have often been to Spain - are there any alternatives? - Mrs Susan Stevens, Eastbourne.
A survey of management holidays in the Wall Street Journal last week claimed that there is a Catch-22 for senior workers: “The enhanced mobility of wireless communications is making it harder for people to disconnect.” According to the report, numerous European high-flyers are spending the beach bars Happy Hour talking to colleagues back home on their mobiles. Technology, naturally, is to blame. The simultaneous arrival of the mobile phone and laptop means theres no escape. The only solution for hard-pressed senior executives is to switch their phones off and claim they are in a location too remote for a signal. But deputies remember - bosses deserve it, thats what they get paid for.

Political Economy of Money and Finance Macmillan, London; and St. Martins Press, New York, 1999. This is an exceedingly important book. it is probably the most important contribution to the Marxian theory of money, credit and finance to appear in English since the translation of Suzanne de Brunhoffs Marx on Money in 1976. Itoh and Lapavitsas book includes a wealth of information, superb literature reviews, profound analyses of the historical evidence and substantiated discussions of controversial policy issues, whose digestion will keep even the most demanding readers busy for a long time. Their argument is invariably thorough, and their research ranges widely, and admirably, from the logical and historical origins of money to free banking, and from long wave theories to socialist money. In spite of its virtues, and partly because of them, this book will probably not become an icon of the literature, although it will certainly become a major reference in the field (which may well be a better option). The reason is simple: Itoh and Lapavitsas probe very deeply into Marxs theory of money and credit, marshal evidence widely, and engage in a wide variety of debates, not least with Marx himself (eg., they criticise certain aspects of Marxs theory of money, on pp.37-40, and credit, on pp.64-5). As their work is very ambitious, complex and controversial, it is unlikely to be universally acclaimed.
